These Terms and Conditions ("Terms") govern the booking, purchase, and ownership of residential units in Malpani Soulstrings ("Project"). By proceeding with the booking or purchase of a unit, you ("Buyer" or "Allottee") acknowledge and agree to abide by these Terms, the Agreement to Sell, and all applicable laws including the Real Estate (Regulation and Development) Act, 2016 (RERA). Please read these Terms carefully before making any booking or payment.

1. Booking and Payment Terms
- Booking of a unit in Malpani Soulstrings is subject to availability and completion of the required booking formalities as per the Application Form.
- The booking amount shall be as per the prevailing rates at the time of booking and is non-refundable in case of cancellation by the Buyer, except as provided under RERA regulations.
- The payment schedule for the unit shall be as per the terms agreed upon between the Buyer and the Developer, as detailed in the Agreement to Sell.
- All payments shall be made via banking channels (cheque, demand draft, NEFT/RTGS) to the designated account of the Developer.

2. Unit Allocation
- Allocation of units shall be done upon receipt of the initial booking amount and execution of the Application Form, subject to availability.
- The Developer reserves the right to allocate units based on availability, construction progress, and other relevant factors as per the approved layout plan.

3. Project Specifications and Modifications
- All specifications, dimensions, layouts, and amenities provided in the brochure, website, or marketing materials are approximate and for general informational purposes only.
- The Developer reserves the right to make alterations, modifications, or substitutions to the project plans, designs, and specifications as deemed necessary for compliance with legal requirements, improvement in construction standards, or unforeseen circumstances, provided such changes do not materially alter the super area or core structure.
- Final specifications shall be as per the Agreement to Sell and the approved building plans.

4. Completion and Possession
- The estimated completion date and possession timeline are provided for informational purposes and are subject to change due to factors beyond the Developer's control, including but not limited to force majeure events, government approvals, and regulatory changes.
- Possession of the unit shall be granted to the Buyer upon completion of the project, receipt of the Occupancy Certificate from the relevant authority, and clearance of all outstanding dues by the Buyer.
- In case of delay beyond the RERA registered timeline, the Buyer shall be entitled to compensation as per the provisions of the RERA Act and the terms of the Agreement to Sell.

5. Legal and Regulatory Compliance
- The Buyer shall comply with all applicable laws, regulations, and guidelines governing the purchase and ownership of property in the jurisdiction where the project is located.
- The Developer shall provide all necessary documentation and assistance to facilitate the legal transfer of ownership of the unit to the Buyer, subject to completion of all payments and formalities.
- The project is registered under MahaRERA with registration number P52100076782. Buyers are advised to verify all project details on the official MahaRERA website at https://maharera.maharashtra.gov.in/.

6. Cancellation and Refund Policy
- In the event of cancellation by the Buyer, the booking amount shall be forfeited as per the terms of the Agreement to Sell and applicable RERA provisions.
- If the Developer cancels the allotment due to non-payment or breach of terms by the Buyer, the Buyer shall be notified in writing, and the refund (if any) shall be processed as per the agreement terms.
- Refunds, if applicable, shall be processed within the timeframe specified in the Agreement to Sell or as mandated by RERA regulations.

7. Maintenance and Association
- Upon possession, the Buyer shall become a member of the Resident Welfare Association (RWA) or condominium association, as applicable.
- Maintenance charges shall be payable as per the terms outlined in the Agreement to Sell and the association's bylaws.

8. Grievance Redressal Mechanism
- For any complaints, queries, or grievances related to the project, booking, or these Terms, please contact the designated Grievance Officer.
- The Grievance Officer shall acknowledge the complaint within 7 working days and endeavor to resolve it within 30 days.
- If the grievance is not resolved to your satisfaction, you may approach the appropriate RERA authority or other competent forum as per applicable laws.

9. Dispute Resolution and Governing Law
- These Terms shall be governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of courts in the jurisdiction where the project is located.
- Any disputes arising out of or relating to these Terms or the Agreement to Sell shall first be resolved amicably through negotiations. If a resolution cannot be reached, the matter shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, or may be pursued through the appropriate RERA authority as per statutory provisions.

10. Amendments to Terms
- The Developer reserves the right to revise or update these Terms at any time without prior notice. Material changes will be communicated through the website or other appropriate channels.
- Your continued engagement with the project after any modification constitutes acceptance of the revised Terms.
